Privacy Policy

This privacy notice (“Notice”) for https://www.inceptionai.org ("Inception," "we," "us," or "our"), describes how and why we might collect, generate, process, store, use, and/or transfer ("process") certain personal information (“Personal Information”) about you that you voluntarily provide to us when you express an interest in obtaining information about us or our products and services (“Services”) through our contact form or if you create an account to use our Services such as when you:

  • Visit our website at inceptioniai.org (“Site”)
  • Use our applications
  • Engage with us in other related ways ― including any sales, marketing, or events

It also tells you about your privacy rights and how the law protects you. We are required by applicable data protection laws to explain certain matters to you. This notice sets out that information. It tells you how you can contact us if you have any suggestions, questions or concerns about how we handle your information. The Abu Dhabi Global Market (“ADGM”) Data Protection Regulations 2021 (“DP Regulations”) apply to how we approach data privacy. In certain circumstances, other laws may apply to Personal Information we process.

Inception will be the controller in relation to the processing of your Personal Information.

WHAT PERSONAL INFORMATION WILL BE PROCESSED?

Although not an exhaustive list, the Personal Information we collect may include the following:

  1. Account Information: Upon registering an account with us, we will receive data linked to your account, encompassing your name, email address and other contact information and account credentials.
  2. User Content: During your utilization of our Services, we gather Personal Information embedded within the inputs you provide, file uploads, or feedback submitted to our Services.
  3. Communication Information: Should you engage in communication with us, we gather your name, contact details, and the substance of any messages you dispatch.
  4. Social Media Information: Our presence extends to social media platforms like Medium, X, and LinkedIn. While engaging with our social media pages, we will accumulate Personal Information that you opt to furnish, like your contact particulars, termed as "Social Information." Moreover, the entities hosting our social media pages might furnish us with aggregated data and analytics pertaining to our social media engagements.
  5. Sensitive Information. We do not process sensitive information.

All Personal Information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such Personal Information.

WHY WILL PROCESSING TAKE PLACE?

Inception will process your Personal Information:

  1. To provide the Services.
  2. To authenticate users and send administrative messages.
  3. For security and fraud prevention.
  4. For data analysis, testing, and research and to monitor and analyse usage and activity trends.
  5. Where necessary, to comply with legal and regulatory requirements.
  6. We will only use your Personal Information when the law allows us to. Most commonly, we will use your Personal Information in the following circumstances:
  7. With your consent for the purposes outlined above.
  8. Where we need to comply with a legal obligation.
  9. Pursuing our legitimate interests by which we mean that the processing of your Personal Information is reasonably necessary in order for us to provide the Services.

WHO ELSE MIGHT YOUR PERSONAL INFORMATION BE SHARED WITH?

Where necessary to achieve the purposes for which we have collected your Personal Information, we may need to share your Personal Information with:

  1. Members of our group companies for internal reasons, primarily for business and operational purposes.
  2. Contractors, consultants and service providers who require the information to assist us in providing the Services including parties that provide products or services to us or on our behalf and parties that collaborate with us to provide the Services.
  3. any court, tribunal, or regulatory, supervisory, law enforcement, governmental or quasi-governmental authority. This includes disclosure to other regulators, official bodies and authorities and law enforcement agencies both inside and outside the ADGM and the United Arab Emirates (“UAE”).
  4. parties involved in investigations (such as firms, individuals and their legal advisers).
  5. any person to whom information is required or requested to be disclosed by any governmental, taxation or other regulatory authority or similar body or pursuant to any applicable law or regulation.
  6. third parties in an aggregated and/or anonymized form which cannot reasonably be used to identify you.
  7. in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We may share your Personal Information with any other person if we notify you and obtain your consent to the disclosure.

When we share Personal Information with third parties, we typically require that they use or disclose that Personal Information only as instructed by us and in a manner consistent with this Notice. We also enter into contracts with these parties to make sure they respect the confidentiality of your Personal Information and have appropriate data security measures in place.

Where Inception transfers your Personal Information outside of the ADGM, we will ensure that the transfer will only be made to jurisdictions deemed to have an adequate level of data protection by the ADGM Office of Data Protection or where we have put in place appropriate safeguards consistent with applicable data privacy practices, laws and regulations. In most cases, the laws of ADGM allow us to share this information without the consent of the individual to whom the Personal Information relates. Where we are required to obtain such consent, we ensure that we obtain adequate consent from the relevant individual in accordance with the DP Regulations. In other cases, we may be compelled to disclose Personal Information due to a mandatory legal obligation or by order of a court or other adjudicatory body or tribunal of competent jurisdiction.

WHERE WE STORE YOUR PERSONAL INFORMATION

The Personal Information that we collect from you may be securely transferred to and securely stored on our databases, located on our secure servers both in UAE and in backup locations in the UAE or abroad.

HOW DO WE KEEP YOUR INFORMATION SECURE?

We store Personal Information in electronic, digital and paper format. We have implemented appropriate and reasonable technical and organizational security measures to prevent your Personal Information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your Personal Information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Information on our instructions, and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected or actual Personal Information breach and will notify you and any applicable regulator of a breach where we are legally required to do so. Where a direct communication to you will involve disproportionate effort, we may instead inform you via a public communication or other similar measures that are equally effective.

Despite our safeguards and efforts to secure your Personal Information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your Personal Information. Although we will do our best to protect your Personal Information, transmission of Personal Information to and from our Services is at your own risk. You should only access the Services within a secure environment.

If at any point you suspect or become aware of a security incident (e.g. you receive a suspicious communication from someone holding themselves out to be our employee or from an unauthorised website claiming to be affiliated with us), please forward the communication to us or report the incident by email to us as soon as possible. 

DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly solicit data from or market to children under 18 years of age (“Minors”). By using the Services, you represent that you are at least 18 years of age or that you are the parent or guardian of such a Minor and consent to such Minor dependent’s use of the Services.

If we learn that Personal Information from Minors has been collected, we will take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from Minors, please contact us at privacy@g42.ai.

HOW LONG WILL YOUR PERSONAL DATA BE KEPT?

Your Personal Information will only be retained for as long as is reasonably necessary for the purposes set out in this Notice, unless a longer period for the retention of Personal Information is required by law (such as tax, accounting, or other legal requirements). No purpose in this Notice will require to keep your Personal Information for longer than 12 months past the initial enquiry.

We may retain your Personal Information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

Personal Information processed based on consent will be retained for the period specified in the consent, or where not specified, until you withdraw your consent.

WHAT ARE YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA?

By law, you have a number of rights when it comes to the Personal Information we process about you.

The right to object to processing - you have the right to object to certain types of processing, including processing for direct marketing (i.e. if you no longer want to be contacted with potential opportunities).

The right to be informed - you have the right to be provided with clear, transparent and easily understandable information about how we use your information and your rights. This is why we’re providing you with the information in this Notice.

The right of access - you have the right to obtain access to your information (if we’re processing it), and certain other information (similar to that provided in this Notice). This is so you’re aware and can check that we’re using your information in accordance with applicable law.

The right to rectification - you are entitled to have your information corrected if it’s inaccurate or incomplete.

The right to erasure - this is also known as ‘the right to be forgotten’ and, in simple terms, enables you to request the deletion or removal of your information where there’s no compelling reason for us to keep using it. This is not a general right to erasure; there are exceptions.

The right to restrict processing - you have rights to ‘block’ or suppress further use of your information. When processing is restricted, we can still store your information, but may not use it further. We keep lists of people who have asked for no further use of their information to be ‘blocked’ to make sure the restriction is respected in future.

The right to data portability - you have rights to obtain and reuse your Personal Information for your own purposes across different services. For example, if you decide to switch to a new provider, this enables you to move, copy or transfer your information easily between our IT systems and theirs safely and securely, without affecting its usability.

The right to lodge a complaint - you have the right to lodge a complaint about the way we handle or process your Personal Information with the ADGM Office of Data Protection by contacting data.protection@adgm.com.

The right to withdraw consent - if you have given your consent to anything we do with your Personal Information, you have the right to withdraw your consent at any time (although if you do so, it does not mean that anything we have done with your Personal Information with your consent up to that point is unlawful). This includes your right to withdraw consent to us using your Personal Information for marketing purposes.
